Terms of Use

These Terms of Use govern your access to and use of the RentPilot Kenya website, progressive web app, mobile applications, APIs, and related services, features and content provided by RentPilot Kenya Limited. By accessing or using the Platform you agree to be bound by these terms. If you do not agree, do not use the Platform.

1. Definitions

Company, we, us, our means RentPilot Kenya. Platform means the website, PWA, mobile application, APIs and associated services. User, you, your means any person or entity using the Platform. Account means the user account registered on the Platform.

2. Acceptance and eligibility

By creating an account or using the Platform you represent and warrant that you are at least 18 years old and have full legal capacity to enter into these Terms. Certain features require a verified account. We may refuse service, suspend or terminate accounts at our discretion if verification fails or if we suspect abusive or illegal activity.

3. Registration, verification and approved users

Access to certain parts of the Platform is limited to registered users who have been approved by us. Registration requires accurate information. You agree to keep your account information current. As part of the verification process we may conduct a short screening call and request identity documents. We reserve the right to approve or deny registration based on our verification policies.

4. User obligations

You must provide accurate information during registration and onboarding.
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
You must use the Platform only for lawful purposes and in compliance with these Terms and applicable law.
You will not interfere with the Platform operations, introduce malware, circumvent access controls, or attempt to gain unauthorized access.

5. Prohibited conduct

Examples of prohibited conduct include, without limitation:

Using the Platform to transmit illegal material or to commit fraud.
Collecting personal information of other users without consent.
Reverse engineering, decompiling or attempting to derive source code from the Platform.
Impersonating another person or misrepresenting your affiliation with any person or entity.

6. Payments, fees and refunds

If the Platform includes any paid features or services they will be described on the Platform. Payment processing may be performed by third party payment providers such as M-Pesa via Daraja API. You agree to the provider terms for payments. We do not store payment credentials such as PINs. Refund and cancellation policies for paid services will be provided where applicable. Unless stated otherwise, fees are non refundable.

7. Intellectual property

All content on the Platform, including text, graphics, logos, icons, images, software and trademarks is owned or licensed by RentPilot Kenya and is protected by intellectual property laws. You may not reproduce, distribute, create derivative works of, publicly display or exploit any part of the Platform without our prior written permission.

8. User content and license

Users may provide content such as property descriptions, photos and messages. By submitting content you grant RentPilot Kenya a worldwide, non exclusive, royalty free license to use, copy, modify, publish and distribute the content for the purpose of operating, promoting, and improving the Platform. You represent that you have the rights to submit the content and that it does not infringe third party rights.

9. Privacy

Your use of the Platform is subject to our Privacy Policy available at /privacy-policy. The Privacy Policy explains how we collect, use and share personal data. By using the Platform you consent to our data practices described in the Privacy Policy.

10. Service availability and changes

We strive to keep the Platform available but do not guarantee uninterrupted access. We may modify, suspend or discontinue features or services at any time. We will attempt to provide notice for material changes but are not required to do so.

11. Disclaimers and warranty

The Platform is provided on an as is and as available basis. To the fullest extent permitted by law we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non infringement. We do not guarantee accuracy of content or suitability of the Platform for your needs.

12. Limitation of liability

To the maximum extent permitted by applicable law RentPilot and its affiliates, officers, directors and employees will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Platform. Our total aggregate liability for direct damages will not exceed the amounts you have paid to RentPilot Kenya in the twelve months preceding the claim, or one hundred US dollars if you have not paid us, whichever is greater.

13. Indemnification

You agree to indemnify, defend and hold harmless RentPilot Kenya and its affiliates from and against any claims, losses, liabilities, damages, costs and expenses arising from your violation of these Terms or your use of the Platform, including user content you submit.

14. Accounts termination and suspension

We may suspend or terminate your account immediately for breach of these Terms, suspected fraud, or illegal activity. Upon termination we may delete or disable access to your account and content. Provisions that by their nature should survive termination will remain in effect.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Kenya, unless otherwise agreed in writing.

16. Changes to these Terms

We may revise these Terms from time to time. If we make material changes we will notify registered users by email or in the Platform. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

17. Notices

We may send notices by email to the address associated with your account or by posting notices on the Platform. Notices to us should be sent to rentpilotkenya@gmail.com or to any postal address we provide on the Platform.

18. Third party links and services

The Platform may include links to third party websites or services. We are not responsible for the content, practices or privacy policies of those third parties. Use of third party services is at your own risk and subject to the third party terms and privacy notices.

19. International users

If you access the Platform from outside Kenya you agree that your use will comply with local law. We make no representation that the Platform is appropriate or available for use in locations outside Kenya.

20. Feedback and contact

If you provide feedback or suggestions regarding the Platform you grant us a non exclusive, royalty free, perpetual license to use the feedback for any purpose without compensation to you. For support, questions or privacy requests contact rentpilotkenya@gmail.com.

21. Entire agreement

These Terms, together with any documents expressly incorporated by reference, constitute the entire agreement between you and RentPilot regarding the Platform and supersede any prior agreements.

22. Severability

If a court finds any provision of these Terms invalid or unenforceable the remaining provisions will remain in full force and effect.

23. Waiver

Failure by RentPilot Kenya to enforce any right or provision of these Terms will not constitute a waiver of such right.
